CNIDH |Déclaration du Président de la CNIDH, Mr. Jean-Baptiste Baribonekeza, au Conseil des Droits de l’Homme, Genève, 29 juin 2016

Excellence Monsieur le Président du Conseil,

Excellence Monsieur le Ministre des Droits de la Personne Humaine, des Affaires Sociales et du Genre de la République du Burundi ;

Excellence Monsieur le Haut Commissaire des Nations Unies aux Droits de l’Homme ;

Excellences, Mesdames, Messieurs ;

Je voudrais d’abord vous remercier pour cette nouvelle occasion d’échanger nos points de vue avec l’éminent Conseil.

La Commission Nationale Indépendante des Droits de l’Homme (CNIDH) note avec satisfaction l’amélioration notable de la situation sécuritaire et des droits de l’homme dans tout le pays depuis le début de l’année 2016, mais surtout au cours des trois derniers mois. La CNIDH estime que ces améliorations sont surtout attribuables au regain de la conviction chez les protagonistes politiques que la voie du dialogue est la meilleure option. La CNIDH encourage les parties prenantes à aller de l’avant.

La CNIDH salue les mesures de désengorgement des prisons récemment prises par la justice burundaise et recommande davantage de célérité dans le traitement des dossiers en particulier ceux relatifs aux cas d’enlèvements et de disparitions.

Monsieur le Président du Conseil,

La CNIDH a déjà eu l’occasion de s’exprimer devant ce Conseil sur la situation des droits de l’homme ayant prévalu en 2015 et au début de l’année 2016.

Nous voudrions ici exprimer notre préoccupation face aux nouvelles tendances, notamment la recrudescence du trafic des êtres humains à destination de pays étrangers. La CNIDH se réjouit du regain de conscience sur le phénomène et des mesures déjà prises par les autorités. Elle encourage le Gouvernement à continuer à prendre toutes les mesures idoines en vue de mettre fin au phénomène.

La CNIDH a également suivi avec préoccupation les actes de gribouillage sur la photo du Président de la République rapportés dans certaines écoles. Nous recommandons une gestion indulgente des dossiers en justice, en privilégiant des peines modérées, alternatives à l’emprisonnement.

Par ailleurs, la réponse judiciaire aux conflits fonciers qui ont atteint une ampleur inquiétante doit être améliorée en vue de parer aux règlements de compte qui vont dans certains cas jusqu’à l’assassinat ou au lynchage.

Enfin, la CNIDH voudrait profiter de cette tribune pour exprimer son point de vue face à la mauvaise compréhension de certains acteurs concernant le travail de protection et de promotion abattu par la Commission dans un contexte de tensions et de violences politiques extrêmes, et en toute indépendance malgré les circonstances difficiles. La CNIDH prend note des observations formulées dans le rapport du Haut-Commissaire des Nations Unies aux Droits de l’Homme. La CNIDH considère que ces observations reflètent l’importance que le HCDH attache à la Commission et à son action. La Commission réitère son ouverture à tout apport tendant à consolider son action et son indépendance, et à la protéger contre les interférences politiques, d’où qu’elles viennent. C’est notre espoir que très bientôt les incompréhensions seront levées et les points de vue harmonisés, grâce aux échanges et à la collaboration déjà engagés.
